1. Introduction
Welcome to Testi Testi ("Application"), a hardware testing utility provided by Pandacat Inc. ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our application. By accessing or using the Application, you agree to be bound by these Terms.
2. Use of the Application
The Application is designed to help users test their computer hardware components, such as keyboards, mice, microphones, cameras, and displays. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial purposes, subject to these Terms.
You agree not to use the Application for any unlawful purpose or in any way that could damage, disable, overburden, or impair the service.
3. AI-Powered Features
Certain features, such as the Microphone Quality test, may use third-party artificial intelligence (AI) services to analyze data you provide (e.g., an audio recording). By using these features, you consent to the transmission of your data to these services for the sole purpose of providing you with the analysis. We do not store this data on our servers after the analysis is complete. Your interaction with AI services may be subject to the terms and privacy policies of the respective AI service providers.
4. User Responsibilities
You are responsible for the data you provide to the Application. You agree that you will not record or transmit any content that is illegal, defamatory, or infringes on the rights of any third party.
5. Disclaimers
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. PANDACAT INC. DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE. THE RESULTS OF THE TESTS ARE FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE CONSIDERED A PROFESSIONAL DIAGNOSIS OF HARDWARE MALFUNCTION.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PANDACAT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APPLICATION.
7. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any significant changes by updating the "Last Updated" date. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pandacat Inc. is established, without regard to its conflict of law principles.
